Despite the fact that a bill was initiated in 2014 to ban Kratom in Oklahoma, the herb remains legal throughout the state to this day. Much of the credit for this accomplishment goes to the local Kratom community, who have acted swiftly whenever there was concern about the legal status of the substance.
As of 2019, Kratom is legal in Oklahoma and can be purchased by people who are at least 18 years of age. Back in 2014, it was the Oklahoma Bureau of Narcotics that proposed a bill to classify Kratom as a Schedule I substance. Their arguments for this change, however, left much to be desired.
For instance, the Oklahoma Bureau of Narcotics relied heavily on the fact that Kratom was illegal in Thailand – its country of origin – at the time. This led them to believe that the local authorities in Thailand had uncovered some kind of negative potential and that the ban stemmed from this discovery. The real reason behind the Kratom ban in the Southeastern country couldn’t be further from the truth.
Indeed, Kratom was banned in Thailand during WWII because it was interfering with the opioids market. While opioids were expensive, Kratom was fairly cheap and did not generate nearly as much in taxes. The government therefore seized the market by banning both Kratom and cannabis in the same year. This was rectified in 2018, when the herb became legal for medicinal purposes.
Back in Oklahoma, the argument was disproved by the local Kratom community, together with the American Kratom Association. The bill failed later that year, after more than 1,000 opposers signed a petition against it. No further attempts to ban Kratom were made since then.
