Is Kratom Legal in Wisconsin?

As of 2019, Kratom is not legal in Wisconsin. The two main alkaloids found in the composition of Kratom were classified as Schedule I substances in 2014. Since then, several attempts to decriminalize the herb were made by the local Kratom community, but, so far, all have been unsuccessful.

Is Kratom Legal in Wisconsin in 2019?

Back in 2013, a bill was proposed in the Wisconsin Senate that aimed to include mitragynine and 7-hydroxymitragynine, the two main components of Kratom, in the list of Schedule I substances. Initially, the two alkaloids were to go under the category of “synthetic opioids”, but since Kratom is neither synthetic, nor an opioid, they were eventually moved under controlled “stimulants”.

In spite of severe lack of evidence that would point to the negative effects of Kratom, the substance was nevertheless banned when the bill passed in 2014. This took place to the dismay of the local Kratom community, whose members have attempted to reverse the ban since then. Although several petitions were launched and signed, none of them was successful.

Furthermore, from a legislative point of view, it is significantly more difficult to remove a substance from the Schedule I list than it is to introduce it in the first place. As such, since scientific evidence supporting Kratom is still scarce, it is unlikely that the ban will be lifted in the near future.

In October 2019, however, the Wisconsin State Health Committee held an informational hearing where the legal status of Kratom was once again brought into question. Participants included members from the American Kratom Association, as well as Curt Bramble, the Utah Senator who first supported the Kratom Consumer Protection Act. 

After the meeting, positive feedback from senators seemed to indicate that a bill to introduce KCPA in Wisconsin may follow in the near future. If this bill is approved, Kratom would not only become legal throughout the state, but its quality would also improve significantly.

Can You Buy Kratom in Wisconsin?

Since Kratom is currently illegal in Wisconsin, it is a felony to own, use, buy, or sell this herb throughout the state from any kratom Vendor. Although it is possible to order Kratom online, we strongly recommend that those who live in Wisconsin refrain from doing so.

Whether or not Kratom will be legalized in Wisconsin depends to a large extent on the reputation of this herb with non-consumers. Felonies tied to Kratom will only damage this reputation and make it more difficult for the community to push for legalization.
